European Product Liability

Více o knize

Thirty years after the implementation of the Directive on liability for defective products, it is crucial to evaluate its adequacy in addressing safety concerns posed by consumer goods utilizing new technologies. This work stems from a comprehensive international research project funded by the Polish National Science Centre, involving scholars from the European Group on Tort Law and the Acquis Group. It features individual country reports that assess the Directive's integration into the domestic laws of various EU and EEA Member States, including Austria, Czech Republic, Denmark, England, France, Germany, Italy, Netherlands, Norway, Poland, Spain, and Switzerland, while also examining its interaction with existing tort law. The findings reveal significant variations in the practical implications of product liability across Member States. Additionally, the analysis extends to non-EU countries such as Canada, Israel, South Africa, and the USA, exploring whether EU law can guarantee adequate safety for consumers using goods produced with emerging technologies like mechatronics, nanotechnology, regenerative medicine, and contour crafting. The book also includes an economic analysis of product liability, making it a valuable resource for academics, practitioners, policymakers, and anyone interested in the topic.
