This work explores the interplay between politics, law, and societal cohesion, beginning with an introduction that sets the stage for the discussion. The first chapter delves into Niklas Luhmann's concept of the evolution of social systems, detailing its subject and methodology. The second chapter critiques the explanatory power of Luhmann's evolutionary framework, addressing aspects like internal selection, structural coupling, and the nature of information. The third chapter examines how information arises within cognitive systems, referencing the map-territory distinction, radical constructivism, and Jean Piaget's genetic epistemology, while questioning the social constitution of knowledge. The fourth chapter focuses on communication systems as solutions to social coordination challenges, framing the coordination of actions as an information problem and highlighting how communication fosters trust and cooperation. The fifth chapter presents an evolutionary perspective on the emergence of information in social systems, proposing a theoretical synthesis and discussing pragmatic evolutionary concepts, alongside implications for ongoing debates about evolution and legislation. Die vorliegende Untersuchung setzt sich mit der Rechtsprechung des Bundesverfassungsgerichts zur Rückwirkung von Gesetzen, zum Vertrauensschutz und zum grundrechtlichen Bestandsschutz bei Übergangsregelungen und mit den kontroversen literarischen Entwürfen auseinander. Auf der Grundlage einer Analyse der gesetzgebungstechnischen Funktion und normativen Struktur von Übergangsregelungen wird nachgewiesen, dass sich zwingende zeitliche Grenzen der Rückanknüpfung von Gesetzen an die Vergangenheit verfassungsrechtlich nicht begründen lassen. Die Suche nach normativen Kriterien des Bestandsschutzes wirft das prinzipielle Problem der Grenzen richterlicher Fortbildung des Verfassungsrechts gegenüber der politischen Entscheidungsbefugnis des Gesetzgebers auf. Das Problem wird exemplarisch bei der Kontrolle von Übergangsregelungen am Masstab der Eigentumsgarantie behandelt.
